Transparency and fairness in the cooperation with our customers is extremely important to us. Therefore, our GTC are designed to clearly and understandably define your rights and obligations as well as our own.
(1) Diese Allgemeinen Verkaufsbedingungen (im Folgenden: AGB) gelten für alle über unseren Online-Shop geschlossenen Verträge zwischen uns, Firma tomm design UG (haftungsbeschränkt) Bleichstr.9 33378 Rheda- Wiedenbrück support@fotografietomm.com (nachfolgend „Verkäufer“ oder „wir“) und Ihnen als unseren Kunden (nachfolgend „Kunde“ oder „Sie“). Die AGB gelten unabhängig davon, ob Sie Verbraucher, Unternehmer oder Kaufmann sind. Maßgebend ist die jeweils bei Abschluss des Vertrags gültige Fassung der AGB.
(2) Abweichende Bedingungen des Kunden akzeptieren wir nicht. Dies gilt auch, wenn wir der Einbeziehung nicht ausdrücklich widersprechen.
(3) Der Kunde ist Verbraucher, soweit der Zweck der georderten Lieferungen und Leistungen nicht überwiegend seiner gewerblichen oder selbständigen beruflichen Tätigkeit zugerechnet werden kann. Dagegen ist Unternehmer jede natürliche oder juristische Person oder rechtsfähige Personengesellschaft, die beim Abschluss des Vertrags in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
(1) Die Präsentation und Bewerbung von Artikeln in unserem Online-Shop stellen kein bindendes Angebot zum Abschluss eines Kaufvertrags dar.
(2) Sie können aus unserem Sortiment Produkte, insbesondere Poster Prints auswählen und diese über den Button „in den Warenkorb legen“ in einem so genannten Warenkorb sammeln. Über den Button „zahlungspflichtig bestellen“ geben Sie einen verbindlichen Antrag zum Kauf der im Warenkorb befindlichen Waren ab. Vor Abschicken der Bestellung können Sie die Daten jederzeit ändern und einsehen. Der Antrag kann jedoch nur abgegeben und übermittelt werden, wenn Sie durch Klicken auf den Button „AGB akzeptieren“ diese Vertragsbedingungen akzeptiert und dadurch in Ihren Antrag aufgenommen haben.
(3) Wir senden Ihnen daraufhin eine automatische Empfangsbestätigung per E-Mail zu, in der Ihre Bestellung nochmals aufgeführt wird und die Sie über die Funktion „Drucken“ ausdrucken können. Die automatische Empfangsbestätigung dokumentiert lediglich, dass Ihre Bestellung bei uns eingegangen ist und stellt keine Annahme des Antrags dar. Der Vertrag kommt erst durch die Abgabe der Annahmeerklärung durch uns zustande, die mit einer gesonderten E-Mail (Auftragsbestätigung) versandt wird. In dieser E-Mail oder in einer separaten E-Mail, jedoch spätestens bei Lieferung der Ware, wird Ihnen der Vertragstext (bestehend aus Bestellung, AGB und Auftragsbestätigung) von uns auf einem dauerhaften Datenträger (E-Mail oder Papierausdruck) zugesandt (Vertragsbestätigung). Der Vertragstext wird unter Wahrung des Datenschutzes gespeichert.
(4) Bestellungen von Lieferungen ins Ausland können wir nur ab einem Mindestbestellwert berücksichtigen. Den Mindestbestellwert können Sie den in unserem Online-Shop bereit gestellten Preisinformationen entnehmen.
(5) Der Vertragsschluss erfolgt in deutscher Sprache.
1) Wir sind zu Teillieferungen berechtigt, soweit dies für Sie zumutbar ist.
(2) Von uns angegebene Lieferzeiten berechnen sich vom Zeitpunkt unserer Auftragsbestätigung, vorherige Zahlung des Kaufpreises vorausgesetzt (außer beim Rechnungskauf). Sofern für die jeweilige Ware in unserem Online-Shop keine oder keine abweichende Lieferzeit angegeben ist, beträgt sie 5 Tage.
(3) Sind zum Zeitpunkt Ihrer Bestellung keine Exemplare des von Ihnen ausgewählten Produkts verfügbar, so teilen wir Ihnen dies in der Auftragsbestätigung unverzüglich mit. Ist das Produkt dauerhaft nicht lieferbar, sehen wir von einer Annahmeerklärung ab. Ein Vertrag kommt in diesem Fall nicht zustande.
(4) Ist das von Ihnen in der Bestellung bezeichnete Produkt nur vorübergehend nicht verfügbar, teilen wir Ihnen dies ebenfalls unverzüglich in der Auftragsbestätigung mit.
(5) Es bestehen die folgenden Lieferbeschränkungen: Wir liefern nur an Kunden, die ihren gewöhnlichen Aufenthalt (Rechnungsadresse) in einem der nachfolgenden Länder haben und im selben Land eine Lieferadresse angeben können: Deutschland
(1) Sämtliche Preisangaben in unserem Online-Shop sind Bruttopreise inklusive der gesetzlichen Umsatzsteuer und verstehen sich zuzüglich anfallender Versandkosten.
(2) Die Versandkosten sind in unseren Preisangaben in unserem Online-Shop angegeben. Der Preis einschließlich Umsatzsteuer und anfallender Versandkosten wird außerdem in der Bestellmaske angezeigt, bevor Sie die Bestellung absenden.
(3) Wenn wir Ihre Bestellung durch Teillieferungen erfüllen, entstehen Ihnen nur für die erste Teillieferung Versandkosten. Erfolgen die Teillieferungen auf Ihren Wunsch, berechnen wir für jede Teillieferung Versandkosten.
(4) Wenn Sie Ihre Vertragserklärung wirksam widerrufen, können Sie unter den gesetzlichen Voraussetzungen die Erstattung bereits bezahlter Kosten für den Versand zu Ihnen (Hinsendekosten) verlangen.
(5) Der Versand der Ware erfolgt per Postversand. Sind Sie Verbraucher, tragen wir das Versandrisiko.
(6) Sie haben im Falle eines Widerrufs des Kaufs die unmittelbaren Kosten der Rücksendung zu tragen.
(1) Sie können in unserem Onlineshop per Rechnung, Kreditkarte oder PayPal bezahlen. Die Zahlung auf Rechnung ist für Neukunden bei der ersten Bestellung nur bis zu einem Warenbestellwert von 100 EUR möglich.
(2) Sie können die in Ihrem Nutzerkonto gespeicherte Zahlungsart jederzeit ändern.
(3) Die Zahlung des Kaufpreises ist unmittelbar mit Vertragsschluss fällig. Ist die Fälligkeit der Zahlung nach dem Kalender bestimmt, so kommen Sie bereits durch Versäumung des Termins in Verzug. In diesem Fall haben Sie uns für das Jahr Verzugszinsen iHv 5 Prozentpunkten über dem Basiszinssatz zu zahlen.
(4) Die Verpflichtung zur Zahlung von Verzugszinsen schließt die Geltendmachung weiterer Verzugsschäden durch uns nicht aus.
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung des Kaufpreises in unserem Eigentum.
(1) Wir haften für Sach- oder Rechtsmängel gelieferter Artikel nach den geltenden gesetzlichen Vorschriften, insbesondere §§ 434 ff. BGB. Die Verjährungsfrist für gesetzliche Mängelansprüche beträgt zwei Jahre und beginnt mit der Ablieferung der Ware. Sind Sie Unternehmer, beträgt die Gewährleistungsfrist auf von uns gelieferte Waren 12 Monate.
(2) Etwaige von uns gegebene Verkäufergarantien für bestimmte Artikel oder von den Herstellern bestimmter Artikel eingeräumte Herstellergarantien treten neben die Ansprüche wegen Sach- oder Rechtsmängeln im Sinne von Abs. 1. Einzelheiten des Umfangs solcher Garantien ergeben sich aus den Garantiebedingungen, die den Artikeln gegebenenfalls beiliegen.
(1) Ansprüche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon ausgenommen sind Schadensersatzansprüche des Kunden aus der Verletzung des Lebens, des Körpers, der Gesundheit oder aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) sowie die Haftung für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Verkäufers, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Wesentliche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist.
(2) Bei der Verletzung wesentlicher Vertragspflichten haftet der Verkäufer nur auf den vertragstypischen, vorhersehbaren Schaden, wenn dieser einfach fahrlässig verursacht wurde, es sei denn, es handelt sich um Schadensersatzansprüche des Kunden aus einer Verletzung des Lebens, des Körpers oder der Gesundheit.
(3) Die Einschränkungen der Abs. 1 und 2 gelten auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen des Verkäufers, wenn Ansprüche direkt gegen diese geltend gemacht werden.
(4) Die sich aus Abs. 1 und 2 ergebenden Haftungsbeschränkungen gelten nicht, soweit der Verkäufer den Mangel arglistig verschwiegen oder eine Garantie für die Beschaffenheit der Sache übernommen hat. Das gleiche gilt, soweit der Verkäufer und der Kunde eine Vereinbarung über die Beschaffenheit der Sache getroffen haben. Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt.

Widerrufsbelehrung
Widerrufsrecht:
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns tomm design UG (haftungsbeschränkt) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.
Sie können das Muster-Widerrufsformular oder eine andere eindeutige Erklärung auch auf unserer Webseite www.fotografietomm.com elektronisch ausfüllen und übermitteln. Machen Sie von dieser Möglichkeit Gebrauch, so werden wir Ihnen unverzüglich (z. B. per E-Mail) eine Bestätigung über den Eingang eines solchen Widerrufs übermitteln.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren. Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
Das Widerrufsrecht besteht nicht bei den folgenden Verträgen:

Verträge zur Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind.

Verträge zur Lieferung von Waren, die schnell verderben können oder deren Verfallsdatum schnell überschritten würde.

Verträge zur Lieferung versiegelter Waren, die aus Gründen des Gesundheitsschutzes oder der Hygiene nicht zur Rückgabe geeignet sind, wenn ihre Versiegelung nach der Lieferung entfernt wurde.

Verträge zur Lieferung von Waren, wenn diese nach der Lieferung auf Grund ihrer Beschaffenheit untrennbar mit anderen Gütern vermischt wurden.

Verträge zur Lieferung alkoholischer Getränke, deren Preis bei Vertragsschluss vereinbart wurde, die aber frühestens 30 Tage nach Vertragsschluss geliefert werden können und deren aktueller Wert von Schwankungen auf dem Markt abhängt, auf die der Unternehmer keinen Einfluss hat.

Verträge zur Lieferung von Ton- oder Videoaufnahmen oder Computersoftware in einer versiegelten Packung, wenn die Versiegelung nach der Lieferung entfernt wurde.

Verträge zur Lieferung von Zeitungen, Zeitschriften oder Illustrierten mit Ausnahme von Abonnement-Verträgen.

Verträge zur Lieferung von Waren, deren Preis von Schwankungen auf dem Finanzmarkt abhängt, auf die der Unternehmer keinen Einfluss hat und die innerhalb der Widerrufsfrist auftreten können.

(1) Wir weisen auf die Online-Streitbeilegung für Verbraucher gemäß Art. 14 Abs. 1 ODR-VO hin: Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit, die Sie unter http://ec.europa.eu/consumers/odr/ finden. Hier kann man in die außergerichtliche Beilegung von Verbraucherstreitigkeiten aus Online-Verträgen eintreten.
(2) Wir sind zu einer Teilnahme an einem Verfahren zur Streitbeilegung vor einer Verbraucherschlichtungsstelle nicht bereit oder verpflichtet.
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Wenn Sie die Bestellung als Verbraucher abgegeben haben und zum Zeitpunkt Ihrer Bestellung Ihren gewöhnlichen Aufenthalt in einem anderen Land haben, bleibt die Anwendung zwingender Rechtsvorschriften dieses Landes von der in Satz 1 getroffenen Rechtswahl unberührt.
(2) Wenn Sie Kaufmann sind und Ihren Sitz zum Zeitpunkt der Bestellung in Deutschland haben, ist ausschließlicher Gerichtsstand der Sitz des Verkäufers. Im Übrigen gelten für die örtliche und die internationale Zuständigkeit die anwendbaren gesetzlichen Bestimmungen.
(3) Der Vertrag bleibt auch bei rechtlicher Unwirksamkeit einzelner Punkte in seinen übrigen Teilen verbindlich. Anstelle der unwirksamen Punkte treten, soweit vorhanden, die gesetzlichen Vorschriften. Soweit dies für eine Vertragspartei eine unzumutbare Härte darstellen würde, wird der Vertrag jedoch im Ganzen unwirksam.
§ 1 Scope
(1) These General Terms and Conditions of Sale (hereinafter: General Terms and Conditions) apply to all contracts concluded between us, tomm design UG, via our online shop(limited liability), Bleichstr. 9, 33378 Rheda-Wiedenbrück support@fotografietomm.com (hereinafter “Provider” or “we”) and you as our customer (hereinafter “Customer” or “you”)
(2) The offer in our online shop is aimed exclusively at entrepreneurs within the meaning of Section 14 Paragraph 1 BGB who, when concluding the contract, are acting in the exercise of their commercial or independent professional activity.
(3) The version of the General Terms and Conditions valid at the time the contract is concluded is decisive. The general terms and conditions also apply to all future business relationships, even if they are not expressly agreed again.
(4) We do not accept any differing conditions from the customer. This also applies if we do not expressly object to the inclusion.
§ 2 Customer account
(1) To purchase and download digital products, the customer must create a simple customer account free of charge. To do this, he enters his name and e-mail address in the registration form, selects a freely selectable password and accepts these terms and conditions. Further data can be provided via the personal profile page after the customer account has been created. Each customer is only allowed to register once. The prerequisite for opening a customer account is that the customer is of legal age.
(2) After sending the completed registration form, the customer receives an automatically generated email containing a hyperlink that he can use to authenticate himself.
(3) The customer is obliged to choose a sufficiently secure password and to keep it secret. As soon as the customer becomes aware or should have become aware that his password is accessible to a third person, he must change the password immediately.
§ 3 Conclusion of contract
(1) The presentation and promotion of items in our online shop do not constitute a binding offer to conclude a purchase contract.
(2) By submitting an order via the online shop by clicking the “order with payment” button, you are placing a legally binding order. You are bound to the order for a period of two (2) weeks after placing the order.
(3) We will immediately confirm receipt of your order placed via our online shop by email. Such an email does not constitute a binding acceptance of the order, unless it also declares acceptance in addition to confirming receipt.
(4) A contract is only concluded when we accept your order through a declaration of acceptance or through delivery of the ordered items.
(5) We can only consider orders for deliveries abroad if there is a minimum order value. You can find the minimum order value in the price information provided in our online shop.
(6) If delivery of the goods you have ordered is not possible, for example because the corresponding digital product is not available, we will not issue a declaration of acceptance. In this case, a contract is not concluded. We will inform you of this immediately and immediately refund any consideration already received.
§ 4 Delivery, availability of goods
(1) If no delivery time is specified in our online shop, the digital product is available for download immediately, provided the purchase price has been paid in advance.
(2) If online delivery is not possible at the time of the customer's order, the provider will immediately inform the customer of this in the order confirmation. If the product is permanently unavailable, the provider will not issue a declaration of acceptance. A contract is not concluded in this case.
(3) If the product specified by the customer in the order is only temporarily unavailable, the provider will also immediately inform the customer of this in the order confirmation.
§ 5 Prices, availability for download
(1) All prices stated on the provider's website are exclusive of the applicable statutory sales tax.
(2) When purchasing digital goods, the provider makes the goods available to the customer via download via their user account.
§ 6 Payment methods
(1) The customer can pay via Paypal make. Payment by invoice is only possible for new customers for their first order up to a goods order value of EUR 500.
(2) The customer can change the payment method stored in his customer account at any time.
(3) Payment of the purchase price is due immediately upon conclusion of the contract. If the due date for payment is determined according to the calendar, the customer is already in default by missing the deadline. In this case, he has to pay the provider default interest for the year amounting to 5 percentage points above the base interest rate.
(4) The customer's obligation to pay default interest does not exclude the provider from asserting further damages due to default.
§ 7 Right of use
(1) The customer does not acquire ownership of digital content, but rather the simple, non-transferable right of use to use the digital content offered for exclusively personal use in the manner offered.
(2) The customer is entitled to download the purchased digital content once, to use it exclusively for personal use and to copy it to his own devices. The customer is not permitted to change the content or editorial content of digital content, to copy it for third parties, to make it publicly accessible, to post it on the Internet or in other networks for a fee or free of charge, to imitate it, to print it out, to resell it or to use it for commercial purposes.
(3) The option to re-download digital content by the provider is voluntary. The provider is entitled to temporarily or permanently change, interrupt or completely discontinue the download option at any time. In addition, if there is an important reason, the provider is entitled to delete individual digital content from the customer account. This is the case, for example, in the case of disputes about possible legal violations. Excluded from the possibility of deletion are digital content that has already been downloaded to the customer's own storage location.
(4) The granting of usage rights to digital content is subject to the suspensive condition of full payment of the agreed purchase price.
§ 8 Warranty for material defects, guarantee, updates
(1) The provider is liable for material defects in accordance with the applicable legal regulations, in particular in accordance with Sections 327 d-h ff. BGB. For entrepreneurs, the warranty period for digital products delivered by the provider is 12 months.
(2) You are obliged to inspect the digital product you have purchased and to report any obvious defects to us immediately. This also applies to hidden defects discovered later. If you violate your obligation to inspect and give notice of defects, the assertion of warranty claims is excluded.
(3) An additional guarantee only exists for the goods delivered by the provider if this was expressly provided in the order confirmation for the respective item.
(4) The customer will be provided with necessary updates (in particular functional updates and security updates) by the provider or the manufacturer in accordance with Section 327f I 3 No. 2 BGB. The provider will inform the customer about the provision. Customers are obliged to install updates that affect the security and functionality of the goods.
§ 9 Liability
(1) Customer claims for damages are excluded. Excluded from this are claims for damages by the customer resulting from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents . Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.
(2) In the event of a breach of essential contractual obligations, the provider is only liable for the foreseeable damage that is typical for the contract if this was caused simply through negligence, unless it concerns claims for damages from the customer resulting from injury to life, body or health.
(3) The restrictions in paragraphs 1 and 2 also apply to the benefit of the seller's legal representatives and vicarious agents if claims are asserted directly against them.
(4) The liability limitations resulting from paragraphs 1 and 2 do not apply if the provider fraudulently concealed the defect or assumed a guarantee for the quality of the item. The same applies if the provider and the customer have reached an agreement about the nature of the item. The provisions of the Product Liability Act remain unaffected.

§ 11 Copyrights
We have copyright to all images, films and texts published in our online shop. Any use of the images, films and texts is not permitted without our express consent.
§ 12 Applicable law and place of jurisdiction
(1) Changes to the contract must be made in writing. Verbal additional agreements, including the written form requirement, must be in writing to be valid.
(2) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you placed the order as a consumer and have your habitual residence in another country at the time of your order, the application of the mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.
(3) If you are a merchant and your registered office is in Germany at the time of the order, the exclusive place of jurisdiction is the registered office of the provider. Otherwise, the applicable legal provisions apply to local and international jurisdiction.
(4) If parts of this contract are wholly or partially ineffective, the validity of the rest will not be affected. In this case, the parties undertake to replace the invalid agreement with one that largely corresponds to the purpose of the contract and is effective.

CANCELLATION POLICY
Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.
In order to exercise your right of withdrawal, you must inform us tomm design UG of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post). You can use the attached model withdrawal form for this purpose, which is, however, not mandatory.
You can also fill in and submit the model withdrawal form or another clear declaration electronically on our website www.fotografietomm.com If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail ).
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the end of the cancellation period.
Consequences of revocation
If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the standard cheapest delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days. You shall bear the direct costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
The right of withdrawal does not apply to the following contracts:

§ 1 Scope of application
(1) These General Terms and Conditions of Sale (hereinafter: GTC) apply to all contracts concluded via our online shop between us, company tomm design UG(limited liability), Bleichstr. 9, 33378 Rheda Wiedenbrück, Germany (hereinafter: "Seller" or "we") and you as our customer (hereinafter: "Customer" or "you"). The GTC apply regardless of whether you are a consumer, entrepreneur or merchant. The version of the GTC valid at the time of conclusion of the contract shall apply.
(2) We do not accept any deviating terms and conditions from the customer. This also applies if we do not expressly object to their inclusion.
(3) The customer is a consumer insofar as the purpose of the ordered deliveries and services cannot be attributed predominantly to his commercial or self-employed professional activity. On the other hand, an entrepreneur is any natural person or legal entity or partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the contract.
§ 2 Conclusion of contract
(1) The presentation and advertising of items in our online shop do not constitute a binding offer to conclude a purchase contract.
(2) You can select products from our range, in particular 14, and collect them in a so-called shopping basket via the button "add to shopping basket". By clicking on the button "order with obligation to pay" you submit a binding application to purchase the goods in the shopping cart. Before submitting the order, you can change and view the data at any time. However, the application can only be submitted and transmitted if you have accepted these contractual terms and conditions by clicking on the "Accept GTC" button and have thereby included them in your application.
(3) We will then send you an automatic confirmation of receipt by e-mail in which your order is listed again and which you can print out using the "Print" function. The automatic acknowledgment of receipt merely documents that we have received your order and does not constitute acceptance of the application. The contract is only concluded when we issue a declaration of acceptance, which is sent in a separate e-mail (order confirmation). (4) We can only consider orders for deliveries abroad with a minimum order value. You can find the minimum order value in the price information provided in our online shop.
(5) The contract shall be concluded in German.
§ 3 Terms of delivery
(1) We are entitled to make partial deliveries insofar as this is reasonable for you.
(2) Delivery times stated by us are calculated from the time of our order confirmation, subject to prior payment of the purchase price (except in the case of purchase on account). If no or no deviating delivery time is specified for the respective goods in our online shop, it shall be 7 days.
(3) If no copies of the product selected by you are available at the time of your order, we will inform you of this immediately in the order confirmation. If the product is permanently not available, we shall refrain from issuing a declaration of acceptance. In this case, a contract is not concluded.
(4) If the product designated by you in the order is only temporarily unavailable, we will also inform you of this immediately in the order confirmation.
(5) The following delivery restrictions apply: We only deliver to customers who have their habitual residence (billing address) in one of the following countries and can provide a delivery address in the same country: Germany
§ 4 Prices and shipping costs
(1) All price quotations in our online shop are gross prices including the statutory value added tax and do not include shipping costs.
(2) The shipping costs are indicated in our price information in our online shop. The price including VAT and applicable shipping costs is also displayed in the order mask before you submit the order.
(3) If we fulfill your order by partial deliveries, you will only incur shipping costs for the first partial delivery. If the partial deliveries are made at your request, we will charge shipping costs for each partial delivery.
(4) If you effectively revoke your contractual declaration, you can demand the reimbursement of costs already paid for shipping to you (delivery costs) under the statutory conditions.
(5) The goods will be dispatched by post. If you are a consumer, we bear the shipping risk.
(6) In the event of a revocation of the purchase, you shall bear the direct costs of the return shipment.
§ 5 Terms of payment
(1) You can pay in our online shop by PayPal.
(2) You can change the payment method saved in your user account at any time.
(3) Payment of the purchase price is due immediately upon conclusion of the contract. If the due date for payment is determined by the calendar, you shall already be in default by missing the deadline. In this case, you shall pay us interest on arrears for the year at a rate of 5 percentage points above the base rate.
(4) The obligation to pay interest on arrears does not preclude us from claiming further damages caused by default.
§ 6 Retention of title
The delivered goods remain our property until the purchase price has been paid in full.
§ 7 Warranty
(1) We shall be liable for material defects or defects of title of delivered items in accordance with the applicable statutory provisions, in particular §§ 434 et seq. BGB. The limitation period for statutory claims for defects is two years and begins with the delivery of the goods. If you are an entrepreneur, the warranty period on goods delivered by us is 12 months.
(2) Any seller's warranties given by us for specific items or manufacturer's warranties granted by the manufacturers of specific items shall be in addition to the claims for material defects or defects of title within the meaning of para. 1. Details of the scope of such warranties shall be set out in the warranty conditions which may be enclosed with the items.
§ 8 Liability
(1) Claims of the customer for damages are excluded. Excluded from this are claims for damages by the customer arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by the seller, its legal representatives or vicarious agents. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.
(2) In the event of a breach of material contractual obligations, the Seller shall only be liable for the foreseeable damage typical for the contract if this was caused by simple negligence, unless it is a matter of claims for damages by the Customer arising from injury to life, limb or health.
(3) The restrictions of paragraphs 1 and 2 shall also apply in favor of the legal representatives and vicarious agents of the seller if claims are asserted directly against them.
(4) The limitations of liability resulting from paragraphs 1 and 2 do not apply insofar as the seller has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The same applies insofar as the seller and the customer have reached an agreement on the quality of the item. The provisions of the Product Liability Act shall remain unaffected.

§ 11 European Dispute Resolution for Consumers
(1) We refer to the online dispute resolution for consumers pursuant to Art. 14 (1) ODR Regulation: The European Commission provides a platform for online dispute resolution (OS), which you can find athttp://ec.europa.eu/consumers/odr/. Here you can enter into the out-of-court settlement of consumer disputes arising from online contracts.
(2) We are not willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board.
§ 12 Applicable law and place of jurisdiction
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you have placed the order as a consumer and have your habitual residence in another country at the time of your order, the application of mandatory legal provisions of this country shall remain unaffected by the choice of law made in sentence 1.
(2) If you are a merchant and have your registered office in Germany at the time of the order, the exclusive place of jurisdiction is the registered office of the seller. Otherwise, the applicable statutory provisions shall apply to the local and international jurisdiction.
(3) The contract shall remain binding in its remaining parts even if individual points are legally invalid. The invalid points shall be replaced by the statutory provisions, if any. Insofar as this would represent an unreasonable hardship for one of the contracting parties, the contract shall, however, become ineffective as a whole.

§ 1 Scope of application
(1) These General Terms and Conditions of Sale (hereinafter: GTC) apply to all contracts concluded via our online shop between us, company tomm design UG(limited liability), Bleichstraße 9, 33378 Rheda-Wiedenbrück, Germany, support@fototgrafietomm.com (hereinafter: "Supplier" or "we") and you as our customer (hereinafter: "Customer" or "you").
(2) The offer in our online shop is aimed exclusively at entrepreneurs within the meaning of § 14 para. 1 BGB (German Civil Code) who are acting in the exercise of their commercial or independent professional activity when concluding the contract.
(3) The version of the GTC valid at the time of conclusion of the contract shall be authoritative. The General Terms and Conditions shall also apply to all future business relationships, even if they are not expressly agreed again.
(4) We do not accept deviating terms and conditions of the customer. This shall also apply if we do not expressly object to their inclusion.
§ 2 Customer account
(1) For the purchase and download of digital products, the customer must create a simple customer account free of charge. To do so, he enters his name and e-mail address in the registration form, determines a selectable password and accepts these GTC. Further data can be entered via the personal profile page after the customer account has been created. Each customer can only register once. The prerequisite for opening a customer account is that the customer is of legal age.
(2) After submitting the completed registration form, the customer will receive an automatically generated e-mail containing a hyperlink via which he can authenticate himself.
(3) The customer is obliged to choose a sufficiently secure password and to keep it secret. As soon as the customer becomes aware or should have become aware that his password is accessible to a third person, he must change the password immediately.
§ 3 Conclusion of contract
(1) The presentation and advertising of items in our online shop do not constitute a binding offer to conclude a purchase contract.
(2) By submitting an order via the online shop by clicking the button "order subject to payment", you place a legally binding order. You are bound to the order for a period of two (2) weeks after placing the order.
(3) We will confirm receipt of your order placed via our online shop immediately by e-mail. Such an e-mail does not constitute a binding acceptance of the order unless, in addition to the confirmation of receipt, the acceptance is declared at the same time.
(4) A contract is only concluded when we accept your order by means of a declaration of acceptance or by delivering the ordered items.
(5) We can only consider orders for deliveries abroad with a minimum order value. You can find the minimum order value in the price information provided in our online shop.
(6) If the delivery of the goods ordered by you is not possible, for example because the corresponding digital product is not available, we shall refrain from issuing a declaration of acceptance. In this case, a contract is not concluded. We will inform you of this immediately and refund any consideration already received without delay.
§ 4 Delivery, availability of goods
(1) If no delivery time is specified in our online shop, the digital product is immediately available for download, provided that the purchase price has been paid in advance.
(2) If online delivery is not possible at the time of the customer's order, the supplier shall inform the customer of this immediately in the order confirmation. If the product is permanently not available, the supplier shall refrain from issuing a declaration of acceptance. In this case, a contract is not concluded.
(3) If the product designated by the customer in the order is only temporarily unavailable, the supplier shall also inform the customer of this immediately in the order confirmation.
§ 5 Prices, commission for download
(1) All prices stated on the website of the Provider are exclusive of the applicable statutory value added tax.
(2) When purchasing digital goods, the Supplier shall make the goods available to the Customer by downloading via his user account.
§ 6 Payment modalities
(1) The customer can pay by Paypal.
(2) The customer can change the payment method stored in his customer account at any time.
(3) Payment of the purchase price is due immediately upon conclusion of the contract. If the due date for payment is determined by the calendar, the customer is already in default by missing the deadline. In this case, he shall pay the supplier interest on arrears for the year at a rate of 5 percentage points above the base interest rate.
(4) The obligation of the customer to pay interest on arrears does not exclude the assertion of further damages caused by arrears by the supplier.
§ 7 Right of use
(1) The customer does not acquire ownership of digital content, but rather the simple, non-transferable right of use to use the digital content offered for exclusively personal use in the manner offered in each case.
(2) The customer is entitled to download the purchased digital content once, to use it exclusively for personal use and to copy it to his own end devices. The customer is not permitted to change the content or editorial content of digital content, to copy it for third parties, to make it publicly accessible, to post it on the Internet or in other networks, whether for a fee or free of charge, to imitate it, to print it, to resell it or to use it for commercial purposes.
(3) The option to re-download digital content by the provider is voluntary. The provider is entitled to temporarily or permanently change, interrupt or completely discontinue the download option at any time. In addition, the provider is entitled to delete individual digital contents from the customer account if there is an important reason for doing so. This is the case, for example, in the event of disputes about possible infringements of rights. Digital content that has already been downloaded to the customer's own storage location is excluded from the possibility of deletion.
(4) The granting of the rights of use to digital content shall be subject to the condition precedent of full payment of the agreed purchase price.
§ 8 Warranty for material defects, guarantees, updates
(1) The supplier shall be liable for material defects in accordance with the applicable statutory provisions, in particular in accordance with §§ 327 d-h ff. BGB. The warranty period for digital products supplied by the Supplier to entrepreneurs is 12 months.
(2) You are obliged to examine the purchased digital product and to notify us immediately of any obvious defects. This also applies to hidden defects discovered later. If you violate your obligation to inspect and report defects, the assertion of warranty claims is excluded.
(3) An additional guarantee exists for the goods delivered by the supplier only if this was expressly given in the order confirmation for the respective item.
(4) Any necessary updates (in particular function-maintaining updates and security updates) shall be made available to the customer by the provider or the manufacturer pursuant to Section 327f I 3 No. 2 BGB. The provider shall inform the customer about the provision. Customers are obliged to install updates that affect the security and functionality of the goods.
